The Federal Antimonopoly Service (hereinafter - the FAS Russia) considered an appeal to clarify the provisions of the Federal Law of July 21, 2005 N 94-FZ "On the placement of orders for the supply of goods, the performance of work, the provision of services for state and municipal needs" (hereinafter - the Law on the placement of orders ) and reports the following.

1. According to clause 1 of part 2 of Article 55 of the Law on Placing Orders, placing an order with a single supplier (performer, contractor) is carried out by the customer if the supply of goods, performance of work, provision of services are related to the scope of activities of natural monopoly entities.

Decree of the Government of the Russian Federation of October 24, 2005 N 637 approved the List of public telecommunications and public postal services, the state regulation of tariffs for which in the domestic market of the Russian Federation is carried out by the Federal Tariff Service, according to which postage stamps (postage stamps, marked envelopes, postage cards) do not belong to public postal services, therefore, they are not activities related to the scope of activities of natural monopoly entities.

This circumstance obliges the customer to place orders for the supply of marked envelopes, postcards and postage stamps in accordance with the provisions of the Ordering Law, in particular, in accordance with part 2 of article 42 of the Ordering Law, the customer is entitled to place orders by requesting quotations if the price of a state or municipal contract does not exceed five hundred thousand rubles, except for the cases provided for in parts 5 and 6 of this article and chapter 5 of the Law on placing orders.

However, in the event that the price of a state or municipal contract exceeds five hundred thousand rubles, the customer is obliged to place orders exclusively by holding an auction in accordance with the provisions of the Law on Placing Orders.

2. Clause 5 of part 2 of Article 55 of the Law on Placing Orders establishes that placing an order with a single supplier (performer, contractor) is carried out by the customer if there is a need for work or services, the execution or provision of which can be carried out exclusively by the executive authorities in accordance with with their powers or state institutions subordinate to them, state unitary enterprises, the corresponding powers of which are established by regulatory legal acts of the Russian Federation, regulatory legal acts of a constituent entity of the Russian Federation.

At the same time, the exclusive powers of the Federal State Unitary Enterprise "Russian Post", including the supply of postage stamps, are not established by the regulatory legal acts of the Russian Federation, the regulatory legal acts of the constituent entity of the Russian Federation, and therefore, the conclusion of state contracts for the supply of marked envelopes, postcards and postage stamps from the Federal State Unitary Enterprise "Russian Post" on the basis of paragraph 5 of part 2 of article 55 of the Law on placing orders is unlawful.

By virtue of Part 2 of Art. 59 of Law 44-FZ, the customer is obliged to conduct an electronic auction if the purchases of goods, works, services included in the list established by the Government of the Russian Federation, or in the additional list established by the supreme executive body of state power of the constituent entity of the Russian Federation when purchasing goods are carried out, works, services to meet the needs of a constituent entity of the Russian Federation, with the exception of cases of procurement of goods, works, services through a request for quotations, a request for proposals, procurement from a single supplier (contractor, performer), taking into account the requirements of this Federal Law.

1. General Provisions

1.1 Postage stamps of the Russian Federation (postage stamps, blocks, marked envelopes and cards) are intended to pay for postage services provided by communication institutions, in accordance with the current tariffs and confirm this on domestic and international correspondence.

1.2 The organization of the publication and distribution of postage stamps is carried out by the Federal Postal Administration (FUPS) under the Ministry of Communications of the Russian Federation in accordance with the Regulations on the Federal Postal Administration, approved by the Resolution of the Council of Ministers of the Government of the Russian Federation dated 14.08.93 No. 798.

1.3 Postage stamps of the Russian Federation must comply with the Charter of the Universal Postal Union and the decisions adopted by the Union bodies, reflect in their stories the multinational state structure of the Russian Federation, the cultural and historical heritage of the peoples living on its territory, flora and fauna, achievements in all fields of knowledge, the main events of domestic and international life, philately.

1.4 The postage stamps of the Russian Federation are issued taking into account the most complete satisfaction of the needs of federal postal institutions, the population, enterprises and organizations.

1.5 Direct planning, publication and distribution of postage stamps, export and import of philatelic goods are carried out by the Marka Publishing and Trade Center of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

1.6 Postage stamps are printed by enterprises of the State Production Association of State Marks of the Ministry of Finance of the Russian Federation (GOZNAK), in accordance with the contracts concluded.

1.7 Institutions of federal postal services throughout the Russian Federation carry out the delivery of domestic and dispatch of international correspondence only if there are postage stamps of the Russian Federation, except for cases stipulated in the Postal Rules (adopted by the Council of Heads of Communications Administrations of the Regional Commonwealth in the field of communications on 04.22.92 with the introduction since October 1, 1992).

1.8 Postage stamps are introduced into the postal circulation by orders of the Federal Postal Administration (postage stamps and blocks, postcards and envelopes with original stamps) and the Marka Publishing Center (stamped envelopes and cards), issued at the beginning of this year on the basis of approved thematic plans.

Unscheduled postage stamps are introduced into postal circulation by additional orders of the Federal Postal Administration or the Marka Publishing Center, respectively.

The date of entry into the postage circulation of postage stamps and blocks, cards and envelopes with original stamps is determined by the "Mark" Publishing Center and communicated to the federal postal administrations.

Marked envelopes and cards are introduced into the postal circulation by federal postal institutions as they are received from manufacturing enterprises or the Marka Publishing Center.

1.9 Under the Federal Postal Administration under the Ministry of Communications of the Russian Federation, a Postal Issues Commission... The tasks of the Commission include determining the general principles of the emission policy, consideration of draft thematic plans for the publication of postage stamps.

The regulations on the Commission and its personal composition are approved by the First Deputy Minister of Communications of the Russian Federation.

5. The procedure for ordering, sending and selling postage stamps in Russiathe Federation

5.1 The Office of the Federal Postal Service forms applications for receiving postage stamps from the Marka Publishing Center of the Russian Federation, taking into account the most complete satisfaction of the needs of federal postal service institutions and the population.

5.2 The procedure for ordering and dispatching postage stamps of the Russian Federation is carried out in accordance with the current regulatory and technical documentation.

5.3 The sale of postage stamps of the Russian Federation is carried out by federal postal institutions strictly at par and not earlier than the deadline established for their introduction into postal circulation (clause 1.8).

5.3.1 Standard postage stamps, pre-stamped envelopes and cards, including those with original stamps, are sold in federal postal offices and are used in postal circulation until their stocks are fully used up or removed from postal circulation.

5.3.2 Artistic postage stamps and blocks are sold at federal postal offices during the year of manufacture and the year following it. After the expiration of the specified period, art stamps and blocks of n by order of the Federal Postal Administration under the Ministry of Communications of the Russian Federation removed from sale at federal postal offices.

5.3.5 The sale of postage stamps and blocks with overprints is carried out within the terms established in the orders of the Federal Postal Administration under the Ministry of Communications of the Russian Federation on their release into postal circulation.

5.4 In order to service collectors in federal postal institutions, a subscription service is organized, which provides for the most complete and preferential supply of members of the Union of Philatelists of Russia and other subscription holders with postage stamps.

The procedure for organizing a philatelic subscription in federal postal institutions and the supply of postage stamps to the Executive Council of the Union of Philatelists of Russia are determined by the current Instruction on the organization of a philatelic subscription in federal postal institutions and the corresponding decisions of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

5.5 Withdrawal from postal circulation of postage stamps of the Russian Federation is made in individual cases by order of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

Postage stamps, withdrawn from postal circulation, are not valid for payment of domestic and international mail.

5.6 Postage stamps withdrawn from sale in federal post offices or withdrawn from postage circulation are collectible philatelic material.

5.7 The publishing and trade center "Marka", in addition to securing applications for postage stamps of federal postal departments, sells ZPOs from the moment they are released into the postal circulation (as philatelic material) to other legal entities and individuals. At the same time, in the event that Marka Publishing Center provides a trade discount to legal entities and individuals not related to the federal postal service, the amount of the discount must providelevel of retail prices for postage stamps in excess of their face value.

I. Postage stamps of the Russian Federation

1. General Provisions

1.1. Postage stamps of the Russian Federation (postage stamps and blocks, marked envelopes and cards) are intended to pay for postage services provided by communication institutions, in accordance with the current tariffs and confirm this on domestic and international correspondence.

1.2. The organization of the publication and distribution of postage stamps is carried out by the Federal Postal Administration (FUPS) under the Ministry of Communications of the Russian Federation in accordance with the Regulations on the Federal Postal Administration, approved by the Resolution of the Council of Ministers - the Government of the Russian Federation dated 14.08.93 N 798.

1.3. The postage stamps of the Russian Federation must comply with the Charter of the Universal Postal Union and the decisions adopted by the bodies of the Union, reflect in their stories the multinational state structure of the Russian Federation, the cultural and historical heritage of the peoples living on its territory, flora and fauna, achievements in all areas of knowledge, the main events of domestic and international life, philately.

1.4. The publication of postage stamps of the Russian Federation is carried out taking into account the fullest satisfaction of the needs of the institutions of the Federal Postal Service, the population, enterprises and organizations.

1.5. Direct planning, publication and distribution of postage stamps, export and import of philatelic goods is carried out by the Publishing and Trade Center "Marka" of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

1.6. Postage stamps are printed by the enterprises of the State Production Association of State Marks of the Ministry of Finance of the Russian Federation (Goznak) in accordance with the contracts concluded.

1.7. Institutions of the Federal postal service throughout the Russian Federation carry out the delivery of domestic and dispatch of international correspondence only if there are postage stamps of the Russian Federation, except for the cases stipulated in the Postal Rules (adopted by the Council of Heads of Communications Administrations of the Regional Commonwealth in the field of Communications on 04.22.92 with introduction from 1 October 1992).

1.8. Postage stamps are introduced into the postal circulation by orders of the Federal Postal Administration (postage stamps and blocks, postcards and envelopes with original stamps) and the Marka Publishing Center (stamped envelopes and cards), issued at the beginning of this year on the basis of approved thematic plans.

Unscheduled postage stamps are introduced into postal circulation by additional orders of the Federal Postal Administration or the Marka Publishing Center, respectively.

The date of entry into the postage circulation of postage stamps and blocks, cards and envelopes with original stamps is determined by the "Mark" Publishing Center and communicated to the departments of the Federal Postal Service.

Marked envelopes and cards are introduced into the postal circulation by the institutions of the Federal Postal Service as they are received from the manufacturing enterprises or the "Marka" Publishing Center.

1.9. Under the Federal Postal Administration under the Ministry of Communications of the Russian Federation, a Commission on Postal Issues is being created. The tasks of the Commission include determining the general principles of the emission policy, consideration of draft thematic plans for the publication of postage stamps.

The regulations on the Commission and its personal composition are approved by the First Deputy Minister of Communications of the Russian Federation.

2. General principles for the formation of thematic plans for the publication of postage stamps of the Russian Federation

2.1. When forming thematic plans for the publication of postage stamps in the Russian Federation, the following principles are taken into account:

2.1.1. Issues of postage stamps of the Russian Federation are not dedicated to living persons.

2.1.2. Outstanding statesmen, scientists and cultural workers, and the arts may be depicted on postage signs of the Russian Federation no earlier than 10 years after death and on anniversaries from the birthday, divisible by 25.

In case of issue of thematic series, deviations from this provision are allowed.

The images of the above persons on the postage signs are made in accordance with the current legislation.

2.1.3. Postage signs of the Russian Federation are not issued with a surcharge to the face value.

2.1.4. Events of historical significance, anniversaries of the formation of republics, territories, regions and cities that are part of the Russian Federation, as well as enterprises, institutions, educational institutions can be displayed on postage signs by dates in multiples of 50.

2.2. Thematic plans for the publication of postage stamps of the Russian Federation are drawn up on the basis of applications from institutions of the Federal Postal Service, proposals from state, public and other enterprises and organizations, the Union of Philatelists of Russia, individuals who entered the Marka Publishing Center no later than 18 months before the start of the planned of the year.

2.3. Drafts of annual thematic plans for the publication of postage stamps and blocks, envelopes and cards with original stamps are submitted by the "Marka" Publishing Center to the Commission under the Federal Postal Administration for postal issues before April 1 of the year preceding the planned one.

The Commission under the Federal Postal Administration for Postal Issues considers these draft plans and recommends them for approval by the First Deputy Minister of Communications of the Russian Federation.

2.4. Annual thematic plans for the publication of artistic stamped envelopes and cards are approved by the Director General of the Marka Publishing Center.

2.5. Thematic plans for the publication of postage stamps must be approved by May 1 of the year preceding the planned one.

2.6. The publication of a series of standard postage stamps is carried out in mass circulation when postage rates change or at least once every 10 years.

As the stamps of the standard issues are used up, they are reprinted taking into account the existing mail needs.

2.7. The publication of unscheduled postage stamps and blocks (including the production of overprints), postage envelopes and cards with original stamps is carried out on the basis of an order of the First Deputy Minister of Communications of the Russian Federation after preliminary consideration by the Commission on Postal Issues.

Proposals for the issue of unscheduled postage stamps and blocks (including the production of overprints), postage envelopes and cards with original stamps are accepted for consideration no later than 6 months before their release into postal circulation.

The production of overprints on postage stamps and blocks is carried out by the enterprises of Goznak of the Ministry of Finance of the Russian Federation, in some cases - by the "Marka" Publishing Center.

3. Number of plots, denominations and circulation of postage stamps

3.1. Annual thematic plans for the publication of postage stamps of the Russian Federation provide for the release of up to 50 subjects of postage stamps and blocks (excluding standard issues), up to 10 subjects of envelopes and cards with original stamps.

The number of plots of art marked envelopes and cards is determined annually by the Marka Publishing Center.

3.2. The denominations of postage stamps correspond to the tariffs for postage services in force on the territory of the Russian Federation.

3.3. The circulation of postage stamps is established taking into account the needs of the institutions of the Federal Postal Service and the population, the commercial activities of the Marka Publishing Center.

The publishing center "Marka" is allowed to produce at the enterprises of Goznak or on its own part of the circulation of postage stamps in canceled form.

4. Development of originals of postage stamps of the Russian Federation and their approval

4.1. After the approval of the thematic plans, the Marka Publishing Center develops the originals of the postage stamps of the Russian Federation planned to be issued. For this, the most capable and creatively thinking artists with experience in the field of miniature are involved.

4.2. The originals of postage stamps, blocks, envelopes and cards with original stamps are reviewed by the Editorial and Artistic Council of the Marka Publishing Center and, if necessary, agreed with experts on this topic.

4.3. The originals of postage stamps and blocks, envelopes and cards with original stamps prepared for delivery into production are approved by the General Director of the Federal Shipping Service under the Ministry of Communications of the Russian Federation, and the originals of artistic stamped envelopes and postcards - by the General Director of the Marka Publishing Center.

4.4. In accordance with the Universal Postal Convention, the following service inscriptions must be placed on postage stamps and blocks of the Russian Federation: the name of the state in Russian and in the Latin transliteration "Russia", face value and year of issue in Arabic numerals. If necessary, it is allowed to issue postage stamps with letter designation the cost of payment (face value).

Service inscriptions should be clearly legible, their location on the stamp is dictated by the compositional decision of the plot.

4.5. After the postage stamps and blocks, envelopes and cards with original stamps are put into circulation, their approved originals, as well as printed projects are transferred by the Marka Publishing Center for storage to the Central Museum of Communications named after A.S. Popov to the fund of the State collection of postage stamps.

5. Procedure for ordering, sending and selling postage stamps of the Russian Federation

5.1. The departments of the Federal Postal Service form applications for receiving from the Publishing Center "Mark" postage stamps of the Russian Federation, taking into account the fullest satisfaction of the needs of the institutions of the Federal Postal Service and the population.

5.2. The procedure for ordering and sending postage stamps of the Russian Federation is carried out in accordance with the current regulatory and technical documentation.

5.3. The sale of postage stamps of the Russian Federation is carried out by the institutions of the Federal Postal Service strictly at the nominal value and not earlier than the deadline established for their introduction into postal circulation (clause 1.8).

5.3.1. Standard postage stamps, pre-stamped envelopes and cards, including those with original stamps, are sold in the Federal Postal Service and are used in postal circulation until their stock is fully used up or withdrawn from postal circulation.

5.3.2. Artistic postage stamps and blocks are sold in the offices of the Federal Postal Service during the year of issue and the year following it. After the expiration of the specified period, artistic stamps and blocks are removed from sale in the institutions of the Federal Postal Service by order of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

Art marks and blocks not sold before the above-mentioned period are subject to destruction in accordance with the established procedure within a month after their withdrawal from sale. A copy of the destruction act is sent to the Marka Publishing Center within a week after its approval. The consolidated act is submitted by the Marka Publishing Center to the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

Artistic postage stamps and blocks discontinued from sale at the institutions of the Federal Postal Service are valid for payment for domestic and international correspondence in accordance with the current postal rates.

5.3.3. The sale of postage stamps and blocks with overprints is carried out within the terms established in the orders of the Federal Postal Administration under the Ministry of Communications of the Russian Federation on their release into postal circulation.

5.4. To service collectors in the institutions of the Federal Postal Service, a subscription service is organized, which provides for the most complete and preferential supply of the members of the Union of Philatelists of Russia and other subscription holders with postage stamps.

The procedure for organizing a philatelic subscription in the institutions of the Federal Postal Service and the supply of postage stamps to the Executive Council of the Union of Philatelicists of Russia is determined by the current Instruction on the organization of a philatelic subscription in the institutions of the Federal Postal Service and the corresponding decisions of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

5.5. Withdrawal from the postal circulation of postage stamps of the Russian Federation is made in individual cases by order of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

Postage stamps, withdrawn from postal circulation, are not valid for payment of domestic and international mail.

5.6. Postage stamps withdrawn from sale in the institutions of the Federal Postal Service or withdrawn from postage circulation are collectible philatelic material.

5.7. The publishing and trade center "Marka", in addition to securing applications for postage stamps of the Federal Postal Service departments, sells ZPOs from the moment they go into postal circulation (as philatelic material) to other legal entities and individuals. At the same time, in the event that Marka Publishing Center provides a trade discount to legal entities and individuals not related to the Federal Postal Service, the amount of the discount must ensure the level of retail prices for postage stamps in excess of their nominal value.

The delivery of postage stamps to the foreign market is carried out by the "Marka" Publishing Center in accordance with the contracts concluded by it or on its behalf with foreign partners.

II. Special postmarks of the russian federation

1. General Provisions

1.1. Special postmarks (SPH) are one of the types of calendar postmarks. They differ from the standard pattern stamps in their external design (additional text, figure), their purposes and the way they are used.

1.2. Special postage stamps are issued by order of the Federal Postal Administration under the Ministry of Communications of the Russian Federation and are used for commemorative cancellation of outgoing mail correspondence in the institutions of the Federal Postal Service.

1.3. The direct planning and production of special postmarks is assigned to the Publishing and Trade Center "Marka" of the Ministry of Communications of the Russian Federation.

1.4. Special postmarks are issued with a fixed and transferable calendar date.

2. General principles for the formation of thematic plans for the manufacture of special postmarks of the Russian Federation

2.1. The plans for the production of SPS are drawn up by the Marka Publishing Center for one year on the basis of proposals from state, public and other enterprises and organizations, the Union of Philatelists of Russia, individuals, agreed with the departments of the Federal Postal Service, where it is planned to carry out a special cancellation.

Applications are accepted for consideration, received by the Publishing Center "Marka" before March 1 of the previous planned year.

2.2. The total number of SPSs should not exceed 100 per year, of which 10 are put into the reserve, while no more than two special postmarks are made for one department of the Federal Postal Service (for Moscow and St. Petersburg no more than 5), excluding postmarks "first day".

2.3. Drafts of annual plans for the production of special postage stamps are submitted by the Marka Publishing Center to the Commission under the Federal Postal Administration for postal issues before April 1 of the year preceding the planned one.

The Commission under the Federal Postal Administration for Postal Issues considers this draft plan and recommends it for approval by the First Deputy Minister of Communications of the Russian Federation.

2.4. The production of unscheduled special postmarks is carried out on the basis of the order of the First Deputy Minister of Communications of the Russian Federation after preliminary consideration by the Commission on Postal Issues. Proposals for the production of unscheduled special cancellation stamps are accepted for consideration no later than 4 months before the date of application of the SPS.

2.5. The production of special postmarks is carried out in accordance with the originals approved by the Director General of the Marka Publishing Center.

When making several copies of the SPS with one text and drawing, each must have a digital or letter difference.

2.6. At the SPS, intended for the institutions of the Federal Postal Service of the republics within the Russian Federation, the autonomous region, autonomous districts, the name of the institution of the Federal Postal Service may be indicated in Russian and national languages. At the request of the customer, the text about the event or anniversary date at the SPS can also be made in Russian and national languages.

2.7. Special postage stamps are issued by order of the Federal Shipping Service under the Ministry of Communications of the Russian Federation, which is issued at the beginning of the current year, and sent to the Federal Postal Service departments in accordance with the established procedure.

2.8. The publishing and trade center "Marka", 1 month before the special cancellation, informs the Federal Postal Service and the Union of Philatelists of Russia about the place, terms of application of a special postmark and postage stamps issued for cancellation and related philatelic materials.

2.9. The accounting procedure for special postage stamps is determined by the order of the General Director of the "Mark" Publishing Center.

3. Application procedure

3.1. The Publishing Center "Marka" sends the SPS to the places of application, taking into account their receipt by the departments of the Federal Postal Service no later than three days before the special cancellation.

3.2. The use of special postmarks is made only for special cancellation by specific institutions of the federal postal service within the period indicated on the stamp or in the accompanying documents. In special cases, the cancellation period may be extended with the permission of the Federal Postal Administration under the Ministry of Communications of the Russian Federation.

3.3. Special postmarks are used to extinguish postage signs that are in postal circulation on the territory of the Russian Federation. The cancellation of the SPS is performed when outgoing correspondence is received for forwarding.

SPS is not affixed to postage signs withdrawn from postal circulation, previously passed through the post, as well as foreign philatelic material.

3.4. The institution of the Federal Postal Service, which conducts special cancellation, informs the population about the time and place of application of the SPS.

3.6. The institution of the Federal Postal Service is obliged to redeem correspondence received from other regions in which a request for cancellation is made.

Responsibility for the correct use and safety of the SPS is assigned to the head of the Federal Postal Service Department, in which the cancellation is performed.

4. Storage order

4.1. Special postage stamps are stored in the Federal Postal Administrations in accordance with the established procedure and must be sent to the Marka Publishing Center the next day after the end of cancellation.

4.2. After receiving the stamps from the departments of the Federal Postal Service, the Publishing Center performs cancellation of the filmmaking material on orders trading network and the Union of Philatelists of Russia, then in the Publishing Center "Marka" on the SPSh a notch is made and they are sent for storage to the Central Museum of Communications named after A.S. Popov.
